I'm rather curious about the sale of this flag.If this was a government issued guidon isn't it still considered Army property?I have read many times where U.S. issued CW Regimental flags that have shown up in private sales have been confiscated for that reason.

Not sure about the guidon however, when Major Walsh of the NWMP bought a 7th Cavalry horse from a Metis who bought it from a Sioux up here in Canada, he checked with U.S. authorities to see if they still had a claim on it.  The reply was that the U.S. government had wriiten off all the missing 7th Cav horses and that he (Walsh) could keep it.  Maybe the same rule applied to the guidon.  I'm just a guessin', mind you.

Since the person who recovered it at the time was a soldier on active duty it would be more in line with theft of government property.I know the government does maintain a list of stolen,lost,and captured cannon that predates the Civil War and actively persue recovery when located from those trying to sell them.Probably a moot point as the flag has been sold.

Might NOT be a moot point since a claim by the gub'mint would void the sale.  However, I doubt they'll bother.  The museum that sold it will use the proceeds to allow acquisition of Indian artifacts for display!  The Indians win again!

I wonder who cut the square just below the field of stars out of it?  It's said that if one wants to find a real Custer carbine that they are all in Canada since that's where Sitting Bull's band retreated to after the fight.  I read that they got rid of most of the stuff they collected after the battle since they didn't want to be arrested when they returned and items would be used as evidence against them.

I'll bet the guidon is legit.  It is quite a find and extremely interesting.  I've seen pictures in books of other flags, or maybe they were of this one; can't recall.
