The perps were still target shooting when the Sheriff (3) deputies arrived and stopped them.

The window is a 60" X 72" Double glass Bay window with side sliders

25 CFR § 11.401 - Recklessly endangering another person.

A person commits a misdemeanor if he or she recklessly engages in conduct which places or may place another person in danger of death or serious bodily injury. Recklessness and danger shall be presumed where a person knowingly points a firearm at or in the direction of another person, whether or not the actor believed the firearm to be loaded.

No malicious intent was involved (they were target shooting which is legal) determined by the investigating Sheriff Sarg. (However, charges can be brought later)

At this point, I have two estimates' next week, I will present the cost to the Perps...
I HOPE it can be resolved with them paying damages.

Shooting Into an Occupied Dwelling
In Florida, if you shoot or throw a “deadly missile” into a building, vehicle or vessel with wanton or malicious intent, you could be facing up to 15 years in prison and a fine of $10,000..
This is true even if absolutely no one was injured as a result of your actions.


Possible Defenses
There are a host of possible defenses in these cases. Prosecutors will sometimes try to use the severity of the charge to strong-arm defendants into pleading guilty to a lesser but still-serious offense. This is not a decision that should be taken lightly. Recognize that there could be an effective way to have the charges significantly reduced or dismissed altogether. Some possible defense strategies may include:

Vehicle was not occupied;  N/A
Lack of sufficient evidence to identify the object; (We have the bullet)
Object was not one that could have produced great bodily harm or death; BULLET !
The shooting, projection or throwing was accidental;
There was no wanton or malicious intention;

Not enough evidence defendant was the one to throw, shoot or project the object. They admit and were in the act of shooting when the Sheriff arrived and saw them !

Good afternoon folks, 47 here right now and sunny. Got the taxes done today and will be getting some back from the gummint. Lady C is on her way to pick up our g'niece who is spending the weekend with us. Taking her to a dairy show for her 4H tomorrow, should be fun. Gonna make a cup of coffee, hmm, maybe that fancy hazelnut stuff.

Evening all.

I put in a good 10.5 hours at the old grindstone today, starting at 5:30. I’ll take that over the 4 hour days I was getting the past two months. Makes bills easier.

Weather here was oddly warm, with a high of 50 degrees.  That’s supposed to stay the same until Monday, at which time it is forecast to drop below zero again. It’s been nice while it’s lasted though.

Went to a funeral tonight that is usually an hour drive. It was snowing on the way there. The wind kicked up to 62 MPH gusts on the way home. Many times I couldn't see the road.  :o

64 here, couldn't get in earlier on any device.  Got a couple bags of chicken legs from the Food Bank so Rita is cooking them to freeze and seal and have microwave food later.   Decided to make batter and back, oven fried or what ever they call it.  Never made it before so she had me look it up. ::)  (She didn't like my turn the oven between 350 and 425 and bake till done so I looked at a couple dozen because I don't trust net recipe.   Oven between 375 and 425, some had no temp but all looked like the same recipe plagiarized.   

I spend a lot of time helping people figure out why their pinned or what ever recipe failed.   Most baking quick breads and involves leavening, calling for baking soda when they need baking powder or forgetting to put self rising on the flour and just putting flower, shit don't leaven itself. :P



When it's done should a say, "It's shaaake un bake and I helped."
